On December 30, 2020, Chinese President Xi Jinping and European leaders announced the conclusion of the negotiations, which began in 2013, for the China - EU investment treaty. The Agreement will then have to be ratified by the end of 2021 by all member states.
The main points of the Treaty are:
Opening up the Chinese market to European companies, especially in the manufacturing, construction, advertising, air transport, maritime services, telecommunications, healthcare and cloud computing sectors, thus creating better conditions of competition. In all of these sectors, China is committed to removing the requirements for setting up joint ventures with local partners to facilitate investments and competition.
Strengthening of Chinese rules for the protection of intellectual property and prohibition of forced technology transfer, as a precondition for investment.
Introduction of rules on the transparency of state subsidies and on fairness and non-discrimination in relations between EU companies and the Chinese public administration.
Encouragement and promotion of environmental and labor protection standards. With the Treaty, China has also committed to adhere to the rules on forced labor indicated by the International Labor Organization (ILO).
Establishment of a mechanism for resolving disputes between states, accompanied by a monitoring mechanism at the political level capable of preventing conflicts in the pre-litigation phase.

Il 30 dicembre 2020 il presidente cinese Xi Jinping e i leader europei hanno annunciato la conclusione dei negoziati, iniziati nel 2013, per il trattato sugli investimenti Cina – UE. L’Accordo dovrà poi essere ratificato entro la fine del 2021 da tutti gli Stati membri.
I Punti principali del Trattato sono:
Apertura del mercato cinese alle aziende europee, in particolare nei settori manifatturiero, costruzioni, pubblicità, trasporto aereo, servizi marittimi, telecomunicazioni, sanitario e cloud computing, creando così migliori condizioni di concorrenza. In tutti questi settori la Cina si impegna a rimuovere i requisiti di costituzione di joint venture con partner locale per facilitare gli investimenti e la concorrenza.
Rafforzamento delle regole cinesi di protezione della proprietà intellettuale e divieto di trasferimento tecnologico forzato, come pre-condizione all’investimento.
Introduzione di regole sulla trasparenza dei sussidi statali e sulla correttezza e non discriminazione nei rapporti tra le imprese europee e la pubblica amministrazione cinese.
Incoraggiamento e promozione di norme ambientali e di tutela del lavoro. Con il Trattato, la Cina si è inoltre impegnata ad aderire alle regole sul lavoro forzato indicate dall’Organizzazione internazionale del lavoro (OIL).
Stabilimento di un meccanismo di risoluzione di controversie tra Stati, accompagnato da un meccanismo di monitoraggio a livello politico in grado di prevenire conflitti in fase pre-contenziosa.
